Terms of Use

1. Who we are

BizGEM is an AI voice-coaching application for Business English, operated by Douglas Stoneman, an individual resident in Brazil, CPF [DOUG_CPF], [DOUG_ENDEREÇO] ("we", "us"). Support: suporte@proequipai.com.

BizGEM is offered in Brazil, in Brazilian reais, to consumers in Brazil.

2. How you pay

Payment is by Pix only. There are no cards, no subscriptions and no foreign payment providers. Pix charges are issued and settled by Asaas Gestão Financeira Instituição de Pagamento S.A., CNPJ 19.540.550/0001-21, the payment institution we use.

A Pix charge must identify the payer, so we collect your CPF (or CNPJ) at checkout and pass it to Asaas for that purpose. Nothing else is done with it. See the Privacy Policy.

Your contract of sale and your contract to use the software are both with us, on these terms.

3. What you are buying

All three are a single payment. None is a subscription and none renews automatically, so there is no recurring charge to cancel.

4. How long access lasts

Access runs for the period of the plan you bought, counted from the day your Pix payment is confirmed. We will tell you before it ends and you may buy again if you wish; if you do not, your modules lock but your account and your practice history remain.

Every purchase carries its own period, and no purchase grants more than that. If you upgrade or buy again, the new period runs from the new payment; it is not added on top of time you already hold.

A Bronze purchase unlocks the one module chosen at checkout. That choice is made once and cannot be swapped afterwards.

5. Your account

You must be 18 or over. An account is for one person: it is personal to you and may not be shared, sold or transferred. You are responsible for keeping your password secure and for activity under your account. Accounts found to be shared between people may be suspended, and an account belonging to someone under 18 will be closed.

6. Fair use

Coaching is delivered by AI services that cost us money for every answer scored. Accounts are therefore subject to automated fair-use thresholds, applied per day and per month, which exist to prevent account sharing and abuse. Ordinary study never meets them. Current limits are published in the app rather than in these terms, so they can be raised without us having to change your contract.

8. Content and intellectual property

All lesson content, scenarios, scoring systems, and the Coach Doug persona and voice are the property of the operator or its licensors. Buying access does not transfer ownership of any of it.

Business scenarios within modules are educational dramatisations written for language training. They are not statements of fact about any real company. All company names and trademarks mentioned belong to their respective owners, and no affiliation, sponsorship or endorsement is implied.

9. AI-generated coaching

Coaching feedback and scores are generated by artificial intelligence. They are educational guidance about language and delivery — not professional, legal, financial or career advice — and may occasionally be inaccurate. Scores measure progress inside BizGEM and carry no certification or qualification value.

10. Your recordings and your words

What you say remains yours. You grant us only the limited licence needed to process your speech in order to transcribe it, score it and give you feedback. We do not store your audio — the recording is transcribed and discarded, as described in the Privacy Policy. We do not use your speech to train voice models, and we do not publish or sell it.

11. Suspension and termination

We may suspend or close an account that breaches these terms — in particular one being shared between people, or used for unlawful, harassing or discriminatory content. Where a breach is not deliberate we will tell you and give you a chance to put it right. If we close a paid account for a breach you did not commit, we refund the unused portion.

12. Refunds

Under article 49 of the Consumer Protection Code (Lei 8.078/1990) you may withdraw within seven days of your purchase, with no reason needed and no charge, and be refunded in full by Pix to the account the payment came from. After those seven days, refunds are given where the law requires them — for example if the service was not delivered or is defective. This is set out in full in our Refund Policy.

13. Availability

We aim to keep BizGEM available throughout your access period, but we do not guarantee uninterrupted service. Features may change or be replaced. If we withdraw the service altogether during a period you have paid for, we will refund the unused portion.

14. Privacy

How we handle your personal data, including what happens to your voice and to the CPF you give at checkout, is described in the Privacy Policy, written to meet the LGPD (Lei 13.709/2018).

15. Liability

To the maximum extent permitted by law, the operator is not liable for indirect or consequential losses arising from use of BizGEM. Nothing in these terms limits liability that cannot lawfully be limited, or affects your rights under the Consumer Protection Code.

16. Changes and governing law

We may update these terms; the version and date are shown above and material changes will be flagged in the app. Changes do not reduce access you have already paid for.

These terms are governed by Brazilian law. The consumer relationship is governed by the Código de Defesa do Consumidor (Lei 8.078/1990) and the processing of personal data by the LGPD (Lei 13.709/2018). Under article 101, I of the Consumer Protection Code, the forum is that of the consumer's own domicile.
